Welcome to NaughtyNest. These Terms of Service ("Terms") govern your access to and use of the website naughtynest.co.uk (the "Site") and any orders you place with us.

Please read these Terms carefully before using the Site or placing an order. By accessing the Site, ticking the age verification gate, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Site.

1. About us

The Site is operated by DE-DE SOLUTION LTD, a private limited company registered in England and Wales under company number 16841073, with its registered office at Flat 1, 12 Hamilton Road, Bournemouth, Dorset, BH1 4EH, United Kingdom ("we", "us", "our", "Naughty Nest"). Our VAT number is GB 511 5613 28.

NaughtyNest is a trading name of DE-DE SOLUTION LTD.

2. Adults only (18+)

The Site sells products intended for adult use only. By using the Site, you confirm and warrant that:

  • You are at least 18 years old.
  • You are legally permitted to view and purchase adult products in your jurisdiction.
  • You will not allow any person under the age of 18 to access the Site through your account, device, or in your presence.

We operate an age verification gate at the entry to the Site. By passing this gate, you make a binding declaration that you are 18 or over. Providing false information about your age is a breach of these Terms and may constitute an offence under UK law.

We reserve the right to refuse service, cancel orders, or close accounts at any time if we have reasonable grounds to believe the user is under 18, including where delivery information, payment information, or browsing behaviour suggests otherwise.

3. Eligibility and territory

The Site is intended for use by adult residents of the United Kingdom only. We only deliver to addresses within the United Kingdom (England, Scotland, Wales, and Northern Ireland).

We do not accept orders for delivery outside the United Kingdom. If you place an order from outside the UK or for delivery to a non-UK address, we reserve the right to cancel the order and refund any payment made.

4. Your account

You may browse and purchase from the Site either as a guest or by creating an account.

If you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Keep your password confidential and not share your account with anyone, including anyone under 18.
  • Notify us immediately if you suspect unauthorised use of your account.
  • Take responsibility for all activity that takes place under your account.

We reserve the right to suspend or terminate accounts that breach these Terms, are inactive for an extended period, or appear to be operated by anyone under 18.

5. Products

We make every effort to display our products accurately, including images, descriptions, materials, and dimensions. However:

  • Product colours, finishes, and textures may vary slightly from images shown on the Site due to screen settings and photography.
  • Product specifications, packaging, and contents may be updated by manufacturers from time to time without notice.
  • Stock is limited and availability is not guaranteed until an order is accepted (see Section 7).

All products sold on the Site are intended for personal, adult use only. They are not toys for children, not medical devices, and are not intended to diagnose, treat, cure, or prevent any medical condition.

You are responsible for using products in line with the manufacturer's instructions, including correct cleaning, charging, lubrication, and storage.

6. Pricing

  • All prices are shown in British Pounds Sterling (GBP) and include VAT where applicable.
  • Delivery charges, if any, are shown separately at checkout before you confirm your order.
  • We reserve the right to change prices at any time. The price you pay is the price displayed at the time we accept your order (see Section 7).
  • Despite our best efforts, pricing errors can occur. If we identify a pricing error in your order, we will contact you before dispatch and you may either confirm the order at the corrected price or cancel it for a full refund.

7. Orders and contract formation

When you place an order, you make an offer to buy the products at the listed price.

  • Submitting an order does not automatically form a contract.
  • After you submit your order, we will send you an order confirmation email. This is an acknowledgement that we have received your order, not an acceptance of it.
  • A binding contract between you and us is formed only when we dispatch the products and send you a dispatch confirmation email. Until that point, we may decline your order for any reason, including stock unavailability, pricing errors, suspected fraud, age concerns, or failed payment authorisation.

If we cannot accept all or part of your order, we will let you know by email and refund any payment taken for the unfulfilled part.

8. Payment

  • We accept the payment methods displayed at checkout.
  • Payment is taken at the time of order.
  • All payments are processed by third-party payment providers (such as Shopify Payments, Stripe, PayPal). We do not store your full card details on our systems.
  • You confirm that the payment method used belongs to you, or that you have express authorisation from the cardholder to use it.

If your payment is declined, reversed, or charged back without legitimate cause, we reserve the right to cancel your order, recover any goods already dispatched, and refuse future orders.

9. Delivery

Delivery terms (timing, methods, costs, discreet packaging) are set out in our Shipping Policy, which forms part of these Terms.

Risk in the goods passes to you on delivery. Ownership passes to you once we have received payment in full.

10. Returns, refunds, and faulty items

Your rights to return, refund, or replace products — including your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015 — are set out in our Returns & Refunds Policy, which forms part of these Terms.

In particular, please note that sealed intimate products cannot be returned or refunded once the hygiene seal has been broken, in line with Regulation 28(3)(b) of the Consumer Contracts Regulations 2013.

11. Acceptable use of the Site

You agree that you will not:

  • Use the Site if you are under 18, or allow anyone under 18 to use it through you.
  • Use the Site for any unlawful, fraudulent, or harmful purpose.
  • Place fraudulent orders, use false identities, or use stolen payment methods.
  • Resell products purchased from the Site without our prior written consent.
  • Attempt to access, scrape, copy, or interfere with the Site, its underlying code, or other users' data.
  • Upload viruses, malicious code, or anything else that could damage the Site or other users.
  • Post reviews or content that is defamatory, obscene (beyond the adult context of the products themselves), harassing, or that infringes anyone else's rights.

We may suspend or terminate your access to the Site at any time if we reasonably believe you are in breach of these Terms.

12. Intellectual property

All content on the Site — including text, product descriptions, images, photography, graphics, logos, the Naughty Nest name and branding, and the underlying code — is owned by us or our licensors and is protected by UK and international intellectual property laws.

You may view, browse, and print pages of the Site for your personal, non-commercial use. You may not otherwise copy, reproduce, distribute, modify, or use any content from the Site without our prior written permission.

Product images and descriptions provided by manufacturers remain the property of their respective owners.

13. Reviews and user-submitted content

If you submit a product review, comment, photo, or any other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, and display that content in connection with the Site, marketing, and our business.

You confirm that any content you submit:

  • Is your own, or you have permission to share it.
  • Does not infringe anyone else's rights.
  • Is not unlawful, defamatory, or misleading.

We reserve the right to remove or edit any user-submitted content at our discretion.

14. Disclaimers

The Site and the products are provided on an "as is" and "as available" basis. While we take care to ensure the Site and product information are accurate, we do not guarantee that:

  • The Site will always be available, error-free, or uninterrupted.
  • Product descriptions, images, or specifications are completely free of errors.
  • The products will be suitable for every individual user or every intended purpose.

You are responsible for assessing whether a product is suitable for you, including with regard to any medical condition, allergy, sensitivity, or compatibility with other products (such as lubricants).

If you have any health condition that may be affected by the use of intimate products, please consult a qualified medical professional before purchasing or using them. We do not provide medical advice.

15. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under UK law.

Subject to that:

  • Our total liability to you for any claim arising out of or in connection with your use of the Site or any order is limited to the total amount you paid for the relevant order.
  • We are not liable for indirect, consequential, or special losses, including loss of profit, loss of opportunity, loss of data, or damage to reputation.
  • We are not liable for any losses arising from your misuse of products, failure to follow manufacturer instructions, or use of products in a manner not intended.

If you are a consumer, this section does not affect your statutory rights under UK consumer protection law.

16. Privacy and cookies

Our use of your personal data is governed by our Privacy Policy and Cookie Policy, which form part of these Terms.

We process your data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

17. Discretion and confidentiality

We understand the sensitive nature of the products we sell. We commit to:

  • Using discreet packaging with no reference to the product or our trading name on the outside.
  • Using a discreet billing descriptor on your card statement where possible.
  • Handling your data and order history with care, in line with our Privacy Policy.

18. Events outside our control

We are not liable for any failure or delay in performing our obligations under these Terms caused by events outside our reasonable control, including but not limited to: courier delays, supplier failures, cyber-attacks, power outages, pandemics, strikes, government action, and natural disasters.

19. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the version published on the Site at the time you place the order. The "Last updated" date at the top of this page shows when the Terms were last changed.

We encourage you to review these Terms periodically. Continued use of the Site after changes are posted means you accept the updated Terms.

20. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any such dispute. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts as provided by law.

21. Other important terms

  • Entire agreement. These Terms, together with our Returns & Refunds Policy, Shipping Policy, Privacy Policy, and Cookie Policy, form the entire agreement between you and us.
  • No waiver. If we do not enforce a right under these Terms, that does not mean we have waived it.
  • Severability. If any part of these Terms is found to be unenforceable, the rest will remain in force.
  • No assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example if we restructure or sell the business.
  • Third parties. No one other than you and us has any right to enforce these Terms.
